1. Acceptance of terms

By accessing or using MyBabe ("the App"), operated by BlueMagikSGO LTD ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of service

MyBabe is an AI-powered emotional companion application. The App provides conversational AI interactions, including text-based messaging and voice conversations. The AI is not a real person. It does not provide medical, psychological, or therapeutic advice. MyBabe is designed for entertainment and emotional companionship purposes only.

3. Eligibility

You must be at least 18 years old to use MyBabe. By using the App, you confirm that you meet this age requirement. We reserve the right to terminate accounts if we reasonably believe a user is under 18.

4. Account registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to update it as needed. You are solely responsible for all activity under your account.

5. Subscriptions and payments

MyBabe offers free and paid subscription tiers. Paid subscriptions are billed through third-party payment processors (Apple App Store). Subscription fees are charged in advance on a recurring basis (monthly or annually) depending on your selected plan.

You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with the policies of the respective app store.

6. Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to exploit, harm, or reverse-engineer the AI system
• Share content that promotes violence, hate speech, or illegal activity
• Misrepresent the AI as a real human being to third parties
• Use the App to generate content that infringes on the rights of others
• Create multiple accounts to circumvent restrictions

We reserve the right to suspend or terminate your access if you violate these terms.

7. AI limitations

The AI companion is a software program. It does not have feelings, consciousness, or genuine emotions. Responses are generated algorithmically and should not be treated as professional advice of any kind, including medical, legal, financial, or psychological advice.

8. Intellectual property

All content, features, and functionality of the App are owned by BlueMagikSGO LTD and are protected by intellectual property laws. You retain ownership of content you submit but grant us a license to use it for the purpose of providing and improving the service.

9. Limitation of liability

MyBabe is provided "as is" without warranties of any kind. To the maximum extent permitted by law, BlueMagikSGO LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Modifications

We may update these terms at any time. Continued use of the App after changes constitutes acceptance of the revised terms. We will notify users of material changes through the App or via email.

11. Termination

We may suspend or terminate your account at our discretion, with or without cause. Upon termination, your right to use the App ceases immediately. Provisions that by nature should survive termination (including limitation of liability and intellectual property) will remain in effect.

12. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Lagos State, Nigeria.
